The state of Delaware recently passed a law that will dramatically increase parking fines for commercial vehicles in residential areas.
On September 9, 2022, House Bill 479 was signed into law by Governor John Carney. The new law went into effect immediately upon signing.
The new law increases the fine for parking large CMVs in residential areas from not less than $28.75 nor more than $230 for a first offense to not less than $100 and not more than $500 for a first offense.
Following the first offense, the penalty for residential truck parking is increased from not less than $115 nor more than $575 to not less than $400 and not more than $2,000.
The new law also allows Delaware transportation officials to “prohibit or restrict the stopping, standing, or parking of any trailer, semi-trailer, or recreational trailer on roadways or sections of roadways,” provided that officials provide law enforcement and the Delaware Department of Safety & Homeland Security with a list of roadways where truck stopping, standing, or parking is prohibited.
