On September 22, 2021, at approximately 7:30AM 1 District St. Catharines uniform officers from the Niagara Regional Police Service (NRPS) responded to a report of a suspected impaired driver.
Officers attended the area of Spring Street near Queenston Street in St. Catharines where they located a blue 2008 GMC Sierra pick up truck parked at the side of the road. Officers located a sole occupant in the truck, a male who appeared to be asleep in the driver’s seat slumped over the steering wheel.
The male awoke and was directed to exit the truck by the officers on scene. The male refused and attempted to put the truck in drive and flee the area. Officers then attempted to prevent him from driving away. A conducted energy Weapon (CEW) (AKA “Taser”) was used, and the officers were able to remove the man from the truck. The man continued to resist officers and the CEW was used again which allowed officers to handcuff the man.
Following his arrest, the man was found to be in a drowsy / impaired state. Emergency medical services were called to the scene to assess the man.
Further investigation by officers at the scene determined the truck was stolen from Niagara on the Lake on September 18, 2021. An examination of the interior of the truck located drug paraphernalia and drug packaging. Officers also located a stolen Ontario licence plate and a “baggy” containing a white powder suspected to be cocaine.
The man was transported to hospital by Niagara Emergency Medical Services paramedics for further assessment.
Jeremy Troy Boyer (31 years) of St. Catharines has been arrested and charged with the criminal offences of:
- Impaired Operation Conveyance, Contrary to Section 320.14(1)(a) of the Criminal Code of Canada.
- Flight From Peace Officer, Contrary to Section 320.17 of the Criminal Code of Canada.
- Resist Peace Officer, Contrary to Section 129(a) of the Criminal Code of Canada.
- Possession of Property Obtained by Crime Over $5000, Contrary to Section 355(a) of the Criminal Code of Canada.
- Possession of Property Obtained by Crime Under $5000, Contrary to Section 355(b) of the Criminal Code of Canada.
- Possession of Schedule I Substance, Contrary to Section 4(1) of the Controlled Drugs and Substances Act.
- Operation while Prohibited, Contrary to Section 320.18 of the Criminal Code of Canada.
- Fail to Comply with Probation Order, Contrary to Section 733.1(1) of the Criminal Code of Canada. (2 Counts)
Boyer was released from police custody at a local hospital on a Form 10 Undertaking. Boyer will appear at the Robert S. K. Welch Courthouse in St. Catharines on December 3, 2021, in relation to this incident.
